Obligation to notify draft national technical regulations and

standardsDirective 98/34/EC remained in force until October 7, 2015, when it was replaced by Directive (EU) 2015/1535 of the European Parliament and of the Council (EU) 2015/1535 on the procedure for the provision of information in the field of technical regulations and rules on information society services, which requires EU Member States to notify draft national technical regulations and standards prior to their adoption. This is followed by a three-month standstill period during which the European Commission and other Member States may comment on the draft. A Member State may not adopt a draft technical regulation before the expiration of this period. These notifications are published in Series C of the Official Journal of the European Union (OJEU) under the heading “Information Procedure – Technical Regulations.” TRIS Technical

System Database To ensure transparency and prevent the creation of technical barriers to trade in the EU internal market, the European Commission has established an information system on Member States’ national technical regulations concerning products (industrial and agricultural, environmental protection, etc.) and rules for information society services, known as the TRIS Information System (T echnical R egulation I nformation S ystem).

The TRIS database (Technical Regulation Information System) contains all notified drafts, including translations into all languages, and is accessible to the public. The TRIS system also offers the option of receiving draft technical regulations via email free of charge. Each Member State has a single contact point for Directive (EU) 2015/1535, which ensures compliance with the obligations arising from this Directive. Each Member State may submit comments on a draft technical regulation from another Member State. The
